Abstract

#The aim of this research is to examine the eligibility to establish an arbitration clause by focusing on the necessary conditions that must be present in both natural persons and legal entities qualified to enter into arbitration. The research adopts a descriptive and analytical approach. It consists of an introduction followed by two sections: the first section examines the eligibility of natural persons to establish an arbitration clause, while the second section addresses the eligibility of legal entities to establish an arbitration clause. The research concludes with a summary. The key findings highlight that the eligibility to establish an arbitration clause is one of the most important areas in international arbitration. Research on this topic, along with the related issues and the development of legislative solutions, contributes to the promotion of commercial arbitration at both the national and international levels.
