Principles of Justice in the Islamic Inheritance System

The aim of the research is to identify the principles of justice on which the Islamic inheritance system is based. The descriptive-analytical approach is followed. The research consists of an introduction which is followed by four sections; the first: Sharia’s [Islamic Law] comprehensive view of justice, the second: the principle of close relationship, not force, the third: the principle of costs and burdens, the fourth: the principle of joint liability. The research ends with a conclusion. The main results are that: the inheritance entitlement system in Sharia [Islamic Law] is based on close relationships and connections that include sharing in life, mutual benefits, and joint material and moral responsibility, far from injustice, whims, and bias. Therefore, absolute equality does not mean justice and right in all cases.
