Legislative main principles in the Qur’an and their relationship to the objectives of Sharia (theoretical and applied study)

Abstract

This study aims to reveal the Qur’anic legislative main principles and their relationship to the purposes of Sharia, and the importance of the Qur’anic rules is highlighted in that they deal with many modern developments and emerging events for which there is no partial evidence. The researcher divided this study into an introduction and three sections. In the first section, he talked about legislative main principles in terms of defining legislative main principles and their types in the Qur’an. In the second section, he talked about their importance in containing many modern developments. He also mentioned features of legislative main principles that make them distinguished from jurisprudential rules and commitments, so that what is not included will be excluded. In the third topic, he listed a set of Quranic legislative main principles that are related to the purposes of preserving the necessary rules and making a model for an applied study of the rules. The study concluded with a set of results and recommendations, the most important of which are: the Qur’anic legislative main principles require a definitive legal ruling and purpose, which apply to all its members and parts in a way that is consistent and exhaustive, and that the legislative main principles differ from the jurisprudential rules, as the legislative main principles are peremptory and do not accept allocation or exception, while the speculative jurisprudential rules accept allocation and exception. The study also concluded that the Quranic legislative main principles are linked to the purposes of the Sharia, as they achieve the purposes of preserving the necessary rules. Recommendations: The researcher recommends to science students and researchers to give the subject of the Quranic legislative main principles priority in studies and research, as it is still a new topic, a broad and large scientific project that needs great efforts to extract these rules, study them, and benefit the nation from them.
