Ibn Abd al-Barr's approach to legal reasoning through his book of Al-Istithka

Abstract

This research is considered to be the scientific study of students of science to discuss the place of legitimate judgement and the its description, in terms of existence and absence; Because the knowledge of systematic controls in the reasoning of the legitimate provisions of the nation's scholars is not based on fancy and decency, but is based on strong principles and norms, the principles of which are understood and whose aims are verified only by those who have attained the rank of knowledge and diligence. A statement of the methodology used by Ibn Abdel-Barr to explain the legitimate provisions and the origins of the evidence on which he relied to explain the legitimate provisions in his recollection classification. Ibn Abd al-Barr's writings - including his book recollection - are characterized by a distinctive approach and an innovative way of composing and categorizing. This was demonstrated by his dissonance with Imam Malik in many matters based on the power of argument and evidence, using research science methods such as extrapolation, descriptivism and evidentiary methods, through which to arrive at the deductive approach that was previously the mayor of study and research.
